This website (eko-fence.bg) and all images, videos, program code and related information in the form of content (hereinafter referred to as "Site" or "the Site") are the property of Marpex Market EOOD, UIC: 206318474, with registered office and management address in Ruse, 128 Lipnik Blvd., Hippodrome.
The purpose of these general terms and conditions is to establish the relationship between Marpex Market EOOD (hereinafter referred to as the "Merchant") and all natural or legal persons (hereinafter referred to as "Customers") who wish to purchase products offered online through the Site.
I. General Provisions
1.1 Information required by the Consumer Protection Act, the Electronic Commerce Act and the European Union Directives on the sale of products on the Internet.

In the event of a dispute related to an online purchase, you may use the ODR website (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage).
1.2 The Site is accessible online at www.marpex-market.bg, and through it Customers can purchase and receive services related to the delivery of products offered on the Site.
1.3 Through the Site, Customers can receive information about new products, their characteristics, prices, delivery terms and promotions organised by the Merchant.
1.4 The Merchant is obliged to deliver the products ordered by Customers within the framework provided by law, guaranteeing the rights of Consumers and fully following good practices in consumer and commercial law.
1.5 The Merchant uses the services of a third party — in this case the courier companies Econt Express OOD or Speedy AD — for the delivery of purchased products to Customers. The delivery price is determined separately and explicitly from the price of the goods, and during the order process Customers are informed of the amount of the delivery fee to be paid to the courier company.
II. Order, Delivery and Order Documents
2.1 To place an order for products offered on the Site, each Customer selects the type and quantity of products they wish to order. The Customer then enters their details, indicates whether they wish to be issued an invoice, and enters the delivery address for the ordered products.
2.2 When placing an order, the Customer must agree to these general terms and conditions. If the Customer does not agree to them, it is not possible to complete the product ordering process. By agreeing to comply with these General Terms and Conditions, the Customer confirms that they have read them, agree to their content and undertake to comply with them.
2.3 When completing the order details, the Customer undertakes to provide accurate, current and correct delivery information — names, address, contact methods. In the event of providing incorrect or false data, the Customer may lose the right to receive the product.
2.4 The email address and telephone number provided by the Customer during the order will be used as a channel for communication and the exchange of electronic documents between the Merchant and the Customer.
2.5 Each Customer may change the details of an order placed only if they request this via an electronic message or telephone call from the contact details provided at the time of the order. Requests to change an order made through means of contact other than those provided (email address or telephone) at the time of the order will not be accepted.
2.6 After the data has been correctly entered, the Customer should submit the order for processing by the Merchant. Upon confirmation of the order, the Customer will receive information about the order placed at the email address previously provided.
2.7 Ordered items are delivered using the services of the courier companies Econt Express OOD or Speedy AD.
2.8 Ordered items are delivered within 5 working days.
2.9 If the Merchant cannot fulfil an order due to the fact that they do not have the ordered goods in stock, they are obliged to notify the Customer.
III. Consumer Protection
3.1 All terms and provisions of this section, as well as the general terms and conditions, apply only to natural or legal persons who may be considered consumers within the meaning of the Consumer Protection Act, the Electronic Commerce Act and/or Directive 2011/83/EC of the European Parliament and of the Council of 25 October 2011.
3.2 The main characteristics of the products offered through the Site are described on the page of the respective product.
3.3 The prices of the products listed on the Site are final, listed in Bulgarian leva (BGN), with VAT and all other taxes or fees required by law included.
3.4 The amount of postage and courier costs for the delivery of products is not included in the price of the products listed on the respective page, but is charged separately. The amount is provided as information during the order process, before the order is submitted for processing by the Merchant. The Customer has the opportunity to review it during the order process, and before submitting an order for processing by the Merchant, all costs that must be paid to receive the products subject to their order are displayed.
3.5 The information provided to Customers is current at the time of its display on the Site, before and during the placement of an order.
3.6 The Merchant is obliged to specify the delivery terms of the individual products on the Site.
IV. Withdrawal from Goods
4.1 The Customer has the right to withdraw from the ordered goods within 14 days of receipt of the goods, provided that they have not been used, the integrity of the packaging has not been broken, and they are in the condition in which they were received, in accordance with the conditions of Art. 55 of the Consumer Protection Act.
4.2 If a defective product is identified within 24 hours of receipt, and the commercial appearance of the goods and packaging is intact, the Merchant undertakes to replace it with a new one in accordance with the warranty conditions of the respective manufacturer, or to refund the amount paid by the customer for the goods in accordance with Art. 55 of the Consumer Protection Act, as of the date on which the customer exercised their right of withdrawal. After this period, or if the commercial appearance or packaging of the goods has been damaged, the repair of the goods shall be borne by the customer.
4.3 Transport and other costs related to the receipt of the goods are at the customer's expense. If the goods do not match the characteristics indicated on the page, the supplier shall refund the entire amount paid by the consumer, including the transport costs paid by the customer for acquiring the goods, in accordance with Art. 59, para. 3 of the Consumer Protection Act and within 14 days of receipt of the goods, provided that the commercial appearance of the goods and packaging has not been damaged.
4.4 Products may only be returned to the address: Ruse, 128 Lipnik Blvd., Hippodrome.
4.5 The Customer undertakes to store the received products with the care of a good owner, to keep the original packaging for the entire warranty period and the period during which the goods may be returned.
V. Other Conditions
5.1 The Merchant delivers and hands over the goods to the Customer within the specified time limits.
5.2 The Customer must inspect all products contained in the delivery at the time of receipt. If one or more of the products does not meet the requirements and technical characteristics, the Customer must notify the Merchant immediately.
5.3 The Merchant guarantees and takes measures to protect the Customer's personal data in accordance with the Personal Data Protection Act.
5.4 The Customer agrees that the Merchant may process their personal data solely for the purposes of the orders placed. The Merchant does not have the right to provide this data to third parties unless ordered to do so by a competent authority of the Republic of Bulgaria.
5.5 By placing an order on the Site, the Customer agrees to receive commercial communications from the Merchant for future marketing purposes and campaigns, and declares that these electronic communications will not be treated as unsolicited commercial communications within the meaning of the Consumer Protection Act and the Electronic Commerce Act.
5.6 These general terms and conditions are permanently visible online at www.marpex-market.bg and may be amended by the Merchant without the Merchant being obliged to provide prior notice.
5.7 The potential invalidity of any of the provisions of these general terms and conditions shall not result in the invalidity of the order placed by the Customer.
5.8 For matters not regulated in these general terms and conditions related to the execution and interpretation of the terms of orders on the Site, both parties shall first refer to the Mediation Court at the Bulgarian Chamber of Commerce and Industry, and then to the Commission for Consumer Protection. If no agreement is reached before the Mediation Court, the laws of the Republic of Bulgaria shall apply through the competent authority for the address and registered office of the Merchant.
